365 Sports Complex Rules and Regulations

These rules are included, but not limited to, for the safety of all people and 365 sports complex.

365 Sports Complex reserves the right to refuse service to anyone.
No athletic field use without prior approval from 365 Sports Complex staff.
No firearms, Knives, ammunition, fireworks, flammable liquids.
Disorderly conduct, obscene behavior, profane language or physical/verbal assault will not be tolerated. Violators will be banned from the premises.
No Smoking of all tobacco products or any other any other substance.
No Drugs allowed on premises. The law will be enforced.
No alcohol consumption allowed on premises.
No Glass bottles or containers on the premises
All Minors not participating must be supervised by an adult at all times.
Speed limit in the parking area is 5mph.
No metal spikes allowed on the fields.
No climbing on trees, goalposts, fences, structures, etc.
No outside Food or drinks except for water.
No bicycles, roller blades, scooters, ripstiks or other wheeled devices allowed on the premises except for disability assistance.
No gum allowed on the fields.
No pets allowed on the premises.
Players, Coaches and Officials only allowed on playing fields on game days or practices.
No cooking or food preparation is allowed in the park without approval from 365 Sports Complex staff.
No person shall engage in the sale of merchandise or operate any concessions without prior approval from 365 Sports Complex Staff.
All advertisements, postings decorations and field markings must be pre-arranged and approved by 365 Sports Complex staff
No loud music is allowed inside the facility
No parking of vehicles on fields, sidewalks, service driveways and emergency zones.
No overnight parking is permitted including RV’s and campers unless approved by 365 Sports Complex staff.
No use of model planes, drones or rockets without approval from 365 Sports Complex staff.
365 Sports Complex may be closed at any time due to safety related reasons.
No Littering and dumping trash on premises.
No loitering or soliciting is allowed at 365 Sports Complex.
Cars parked in handicapped parking spaces without a handicap sticker will be fined.
Participation as spectators, coaches, players, vendors, walkers, runners, playground areas, and picnic areas are at your own risk. 365 Sports Complex is not responsible for injuries, stolen property or broken property. Be alert at all times.
Failure to comply with these rules will result in immediate removal from the premises.

Code of Conduct

No foul language such as profanity, blasphemy, obscenity, swearing, racism, sexism, and vulgarism allowed.
If a player or any of his/her family and/or friends break our code of conduct or policy, they will be asked to leave. If refused to leave, the complex will be force to call the authorities and player/family/friends will lose their right to be admitted to the complex in the future. In addition, no refund will be issued for the player/family/friend.
Harassment, bullying will not be tolerated at any time.
Abuse or assault will not be tolerated at any time. Unfair and prejudicial treatment towards any person or group. Discriminatory phrases or words against another person. Examples include but are not limited to: personal attacks based on race, gender, age, religion, sexual orientation and physical abilities.
Reporting misconduct will be confidential and will not be used for future reprisal against our players, teams and/or their family members and friends.
No Illegal activities, such as vandalism, and robbery.

Waiver & Release Liability.

I, for myself or as the parent or guardian with legal responsibility of the minor child that plans to participate in the program’s activities, for valuable consideration given, the receipt and sufficiency of which is hereby acknowledged, do hereby acknowledge and agree as follows:

1. Acknowledgement of Inherent Risks of Participation. I understand that the risk of injury from the activities involved in the program is significant, including the potential for serious personal injury, and while particular rules, equipment and personal discipline may reduce this risk, the risk of serious injury does exist.

2. Assumption of the Risks. I acknowledge, understand, and appreciate the types of injuries inherent in the activities and knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releases (as defined below) or others and assume full responsibility for my own/child’s participation.

3. Waiver & Release Liability. I, for myself and/or my child and spouse, and on behalf of my heirs, assigns, personal representatives and next to kin, hereby release and hold harmless 365 Sports Complex, LLC, their officers, officials, agents and/or employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the activities (“Releasees”), with respect to any and all injury, disability, death or loss or damage to person or property incident to my or my child’s involvement or participation in these activities as provided above, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.

4. Certification. I certify that: (i) I am at least 18 years of age or have reached the age of majority in the jurisdiction in which I live or reside; (ii) I or my child will comply with the stated and customary terms, rules and conditions for participation; (iii) I am, or my child is, in good physical condition and can participate in sports and related activities, and further agree and warrant that at any time I believe conditions to be unsafe, I will immediately discontinue further participation for myself or my child in the activity. If an emergency arises, I authorize the request and/or administration of medical treatment to myself, or my child, if and as necessary.

5. Indemnification. I agree to hold harmless, defend, and indemnify the Releasees, defend and pay any costs, including damages awarded, investigation costs, reasonable attorney’s fees, and related expenses from any and all claims arising from my or my child’s participation in the activities. I further agree to hold harmless, defend, and indemnify the Releasees against any and all claims of co-participants, rescuers, and others arising from my and/or my child’s conduct in such activities.

6. Likeness and Image. I also consent and agree that 365 Sports Complex, LLC (and their designees, if applicable) has the right to take photographs and video of myself or my child during activities. These photos and video may be used on the website (www.365sportscomplex.net) and related social media pages, media releases and promotional materials. I understand that neither I nor my child/ward will receive any compensation if such image appears in any of the manners listed above or any other manner that the league deems appropriate. I agree that such image is the property of 365 Sports Complex, LLC. I understand that my/child’s/ward’s name and identity will not be revealed.

7. Acknowledgment and Understanding. I acknowledge that I have read and understand this Assumption of Risk and Release of Liability. I acknowledge and understand that I am giving up substantial rights, including the rights of my child and spouse to sue for damages in the event of death, injury, or loss. I acknowledge that I am voluntarily agreeing to these terms, conditions, waivers and releases and intend this agreement to be a complete release of all liability, including that due to negligence by the Releasees, to the greatest extent allowed by applicable law; and that if any portion thereof is held invalid, the balance hereof shall, notwithstanding, continue in full legal force and effect.

8. Entire Agreement. I confirm that this Assumption of Risk and Release of Liability supersedes any and all previous oral or written promises or agreements relating to the subject matter herein. I understand that this is the entire agreement regarding waiver and acceptance of risk and cannot be modified or changed in any way by representations or statements by any agent, employee or volunteer of 365 Sports Complex, LLC. I understand the foregoing Assumption of Risk and Release of Liability, and indemnification agreement is intended to be as broad and inclusive as permitted by applicable law.

Concussion Waiver:

A concussion is a type of traumatic brain injury—or TBI—caused by a bump, blow, or jolt to the head or by a hit to the body that causes the head and brain to move rapidly back and forth. This sudden movement can cause the brain to bounce around or twist in the skull, creating chemical changes in the brain and sometimes stretching and damaging brain cells.

The CDC estimates as many as 3.8 million concussions occur in the U.S. annually through sports and recreational activities.

The Facts Recognizing a Possible Concussion

1. A concussion is a brain injury.

2. All concussions are serious.

3. Concussions can occur without loss of consciousness.

4. Concussions can occur in any sport.

5. Recognition and proper management of concussions when they first occur can help prevent further injury or even death.

To help recognize a concussion, you should watch for the following two things among your athletes:

1. A bump, blow, or jolt to the head or body that results in rapid movement of the head.
2. Any change in the athlete’s social or emotional behavior, thinking or remembering, physical or sleep functioning. You may notice signs before the athlete does.

Recognize the Signs and Symptoms!

Feeling tired, no energy
Headaches
Nausea or vomiting (early on)
Vision problems

THINKING OR REMEMBERING

Attention or concentration problems
Feeling slowed down
Foggy or groggy
Problems with memory (short or long-term)
Trouble thinking clearly

SOCIAL OR EMOTIONAL

Anxiety or nervousness
Irritability or easily angered
Feeling more emotional
Sadness

SLEEP

Sleeping less than usual
Sleeping more than usual
Trouble falling asleep

An athlete who is suspected of sustaining a concussion or head injury will be removed from the practice or game immediately and will not be allowed to return to play without written clearance from a licensed health care provider. The player should not be left alone, and the parent/guardian will be notified to follow up accordingly.

As the participant and in consideration of being allowed to participate in any way in 365 Sports Complex, LLC. related events and activities, I agree and understand the following:

All deposits and fees are non-refundable under all circumstances.
There are no guarantees to the number of games or amount of time the participant will play.
I understand that the chief goal of 365 Sports Complex is to have an outstanding experience. I will notify 365 Sports Complex Director of my issue/concern in writing as soon as possible so that he/she may have the opportunity to correct it.
I will follow all rules, regulations and bylaws set by 365 Sports Complex LLC, and their respective assigns, licensees and legal representatives.

I have read this registration agreement and fully understand its terms. I also understand that I have given up certain rights by signing it, as described above, which I agree to do voluntarily.

RELEASE OF LIABILITY, INDEMNIFICATION AND COVENANT NOT TO SUE HOLDER, ON BEHALF OF HOLDER, ANY ACCOMPANYING PARTY AND THEIR PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, NEXT OF KIN AND ANY OTHER PERSON OR ENTITY THAT MAY BE ENTITLED TO MAKE A CLAIM ON THEIR BEHALF, AGREE TO INDEMNIFY, DEFEND, WAIVE, RELEASE, DISCHARGE, HOLD HARMLESS, AND COVENANTS NOT TO SUE 365 SPORTS COMPLEX, ITS EMPLOYEES, VOLUNTEERS, OR ANY ENTITIES (AS DEFINED BELOW) (THE "RELEASED PARTIES") WITH RESPECT TO ANY CLAIM, LOSS, LIABILITY, COSTS, EXPENSE (INCLUDING ATTORNEY'S FEES) OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, (A) USE OF PREMISES, (B) PRESENCE AT THE PARKING LOT OR (C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (1) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (2) THE INHERENT RISKS ASSOCIATED WITH VISITING 365 SPORTS COMPLEX, INCLUDING, WITHOUT LIMITATION (a) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 AND/ OR VARIANTS OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTY OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTY; AND (b) ALL CLAIMS IN CONNECTION WITH THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO HOLDER OR ANY ACCOMPANYING PARTY. "365 SPORTS COMPLEX Entities" as used herein are any organization, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with 365 SPORTS COMPLEX and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19, ITS VARIANTS or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable. I, player/ parent/ visitor and/or spectator, am responsible for my or my child health insurance and all costs that can be associated with it.

BY CHECKING THE BOX ON THE REGISTRATION FORM, I ACKNOWLEDGE THAT I, FOR MYSELF, MY SPOUSE, AND CHILD, HAVE READ THIS ASSUMPTION OF RISK AGREEMENT AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
